{"id":760,"date":"2025-07-07T11:06:53","date_gmt":"2025-07-07T11:06:53","guid":{"rendered":"https:\/\/blog.cedritech.com\/?p=760"},"modified":"2025-07-07T11:07:05","modified_gmt":"2025-07-07T11:07:05","slug":"texas-lawmakers-failed-to-pass-a-bill-to-improve-local-disaster-warning-systems-this-year","status":"publish","type":"post","link":"https:\/\/blog.cedritech.com\/?p=760","title":{"rendered":"Texas lawmakers failed to pass a bill to improve local disaster warning systems this year"},"content":{"rendered":"<p class=\"mb-4 text-lg md:leading-8 break-words\">For the last three days, state Rep.\u00a0<a class=\"link \" href=\"https:\/\/www.texastribune.org\/directory\/wes-virdell\/\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:Wes Virdell;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"43\" data-v9y=\"1\">Wes Virdell<\/a>\u00a0has been out with first responders in Kerr County as they searched for victims and survivors from the devastating floods that swept through Central Texas early Friday morning.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cAll the focus right now is let\u2019s save all the lives we can,\u201d Virdell, who was still on the scene in Kerrville, told The Texas Tribune on Sunday.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Virdell\u2019s closeup view of the havoc wreaked on\u00a0<a class=\"link \" href=\"https:\/\/www.texastribune.org\/directory\/districts\/tx-house\/53\/\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:his district;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"44\" data-v9y=\"1\">his district<\/a> has made a lasting impression, he said, and left him reconsidering a vote he made just a few months ago against a bill that would have established a statewide plan to improve Texas\u2019 disaster response, including better alert systems, along with a grant program for counties to buy new emergency communication equipment and build new infrastructure like radio towers.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cI can tell you in hindsight, watching what it takes to deal with a disaster like this, my vote would probably be different now,\u201d said Virdell, a freshman GOP lawmaker from Brady.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The measure,\u00a0<a class=\"link \" href=\"https:\/\/capitol.texas.gov\/BillLookup\/History.aspx?LegSess=89R&amp;Bill=HB13\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:House Bill 13;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"45\" data-v9y=\"1\">House Bill 13<\/a>, would have created a new government council to establish the emergency response plan and administer the grant program, both of which would have been aimed at facilitating better communication between first responders. The bill also called for the plan to include \u201cthe use of outdoor warning sirens,\u201d like those used in tornado-prone Texas counties, and develop new \u201cemergency alert systems.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Authored by Rep.\u00a0<a class=\"link \" href=\"https:\/\/www.texastribune.org\/directory\/ken-king\/\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:Ken King;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"46\" data-v9y=\"1\">Ken King<\/a>, R-Canadian, the legislation was inspired by last year\u2019s\u00a0<a class=\"link \" href=\"https:\/\/www.texastribune.org\/series\/texas-panhandle-wildfire\/\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:devastating wildfires;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"47\" data-v9y=\"1\">devastating wildfires<\/a>\u00a0in the Panhandle, where more than 1 million acres burned \u2014 including part of King\u2019s property \u2014 and three people died. The bill failed in the Texas Senate, prompting\u00a0<a class=\"link \" href=\"https:\/\/texasruralreporter.substack.com\/p\/lessons-not-learned?r=5xo8&amp;utm_medium=ios&amp;triedRedirect=true\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:newfound questions;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"48\" data-v9y=\"1\">newfound questions<\/a>\u00a0about whether lawmakers should have done more to help rural, cash-strapped counties stave off the deadly effects of future natural disasters.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">As of Sunday evening, at least 79 people had died in the floods. Of those, 68 were in Kerr County, many of them camping or attending a private summer camp along the Guadalupe River.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Virdell, a Hill Country native who lives about 100 miles away, made his way to Kerrville early Friday after seeing news that rains raised the Guadalupe more than two feet, swamping its banks in Hunt and other river communities that host thousands of holiday vacationers.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">He stressed an alarm system may not have helped much in this instance because the floodwaters came so quickly. Between 2 and 7 a.m., the Guadalupe River in Kerrville rose from 1 to more than 34 feet in height,\u00a0<a class=\"link \" href=\"https:\/\/waterdata.usgs.gov\/monitoring-location\/USGS-08166200\/#dataTypeId=continuous-00065-0&amp;period=P7D\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:according to a flood gauge in the area;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"49\" data-v9y=\"1\">according to a flood gauge in the area<\/a>.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cI don&#8217;t think there was enough evidence to even suspect something like this was going to happen,\u201d he said. \u201dI think even if you had a warning system there, this came in so fast and early in the morning it&#8217;s very unlikely the warning system would have had much effect.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Virdell said he doesn\u2019t recall the specifics of the bill or why he opposed it, though he guessed \u201dit had to do with how much funding\u201d was tied to the measure.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Even if it had passed, it would not have gone into effect until Sept. 1, after the Hill Country flooding.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The bill\u2019s\u00a0<a class=\"link \" href=\"https:\/\/www.texastribune.org\/2025\/04\/01\/texas-wildfire-legislation-house-votes\/#:~:text=House%20Bill%2013%20would%20create,Texas%20Tribune%20thanks%20its%20sponsors.\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:initial $500 million cost;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"50\">initial $500 million cost<\/a>\u00a0drew heavy criticism from fellow Republicans including state Rep.\u00a0<a class=\"link \" href=\"https:\/\/www.texastribune.org\/directory\/tony-tinderholt\/\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:Tony Tinderholt;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"51\">Tony Tinderholt<\/a>, R-Arlington.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cThis shouldn&#8217;t be about anything other than the fact that it&#8217;s a half a billion dollars,\u201d Tinderholt, a hardline conservative and budget hawk, said during the April 1 House floor debate. \u201cThis is probably one of the most simple votes we should be able to take today. It&#8217;s that this interoperability council is going to spend money to try and get these departments to be able to talk together.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Steven Aranyi, a spokesperson for Lt. Gov.\u00a0<a class=\"link \" href=\"https:\/\/www.texastribune.org\/directory\/dan-patrick\/\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:Dan Patrick;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"52\">Dan Patrick<\/a>, noted that lawmakers \u2014 including the Texas Senate, which Patrick oversees \u2014 made several \u201cunprecedented\u201d investments in disaster response during this year\u2019s legislative session, totaling $547 million. That included:<\/p>\n<ul class=\"mb-4\">\n<li class=\"ml-4 list-disc\">\n<div class=\"\">\n<p class=\"mb-4 text-lg md:leading-8 break-words\">$257 million for disaster response aircraft,<\/p>\n<\/div>\n<\/li>\n<li class=\"ml-4 list-disc\">\n<div class=\"\">\n<p class=\"mb-4 text-lg md:leading-8 break-words\">$135 million for regional operation facilities,<\/p>\n<\/div>\n<\/li>\n<li class=\"ml-4 list-disc\">\n<div class=\"\">\n<p class=\"mb-4 text-lg md:leading-8 break-words\">$90 million to provide ambulances to rural counties,<\/p>\n<\/div>\n<\/li>\n<li class=\"ml-4 list-disc\">\n<div class=\"\">\n<p class=\"mb-4 text-lg md:leading-8 break-words\">$65 million for emergency response drone technology.<\/p>\n<\/div>\n<\/li>\n<\/ul>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The flaw with HB 13, Aranyi said, was that it proposed rolling out the local grant money over an estimated timeline of up to 10 years.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cBy the time any system was developed, it would be outdated due to advances in technology,\u201d Aranyi said. \u201cThe grants in the bill were limited to planning purposes only; they did not support disaster response.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">As the disaster quickly unfolded in Kerr County, located in the heart of an area known for flash floods, much has been made of the fact that the county lacked a siren system that counties in other parts of Texas have to alert residents of tornadoes. Such a system has been considered before in Kerr County, but quickly dismissed because the high cost would fall alone on local taxpayers.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">A flash flood watch was issued by the National Weather Service by Thursday afternoon for the region. Then, in the middle of the night, at 1:14 a.m. Friday, a flash food warning was issued as possibly \u201ccatastrophic,\u201d for Bandera and Kerr Counties, according to the NWS. Those alerts would have automatically triggered Wireless Emergency Alerts on enabled mobile devices,\u00a0<a class=\"link \" href=\"https:\/\/www.nbcdfw.com\/news\/local\/texas-news\/national-weather-service-alert-timeline-texas-flooding\/3879084\/\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:the weather service said;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"53\" data-v9y=\"1\">the weather service said<\/a>.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">But because the alerts went out when most residents and visitors were asleep, coupled with the fact that many of those children attending summer camp as well as their counselors were without cell phones, the alerts likely went unheeded by many.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Residents who were up before daylight on Friday 4 reported rain misting by 3 a.m. but nothing out of the ordinary. That changed quickly by 5 a.m. Friday when flooding was detected on roadways in Kerr County.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The flooding reached its peak at around 6:45 a.m. in Kerrville, hours after warnings were first issued, according to the local flood gauge.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Kerr County Judge Rob Kelly told reporters on Saturday local residents have rejected the idea of a siren system due to its expense when it had been suggested before.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cThe public reeled at the cost,\u201d\u00a0<a class=\"link \" href=\"https:\/\/www.pbs.org\/newshour\/nation\/texas-officials-face-scrutiny-over-lack-of-evacuation-orders-before-deadly-flooding\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:Kelly said;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"54\" data-v9y=\"1\">Kelly said<\/a>.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">At a news conference on Sunday, Gov.\u00a0<a class=\"link \" href=\"https:\/\/www.texastribune.org\/directory\/greg-abbott\/\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:Greg Abbott;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"55\" data-v9y=\"1\">Greg Abbott<\/a>\u00a0left the door open to legislation aimed at improving emergency warning systems, but stopped short of saying he would put it on the agenda for lawmakers to consider during the special session he has scheduled to begin July 21.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cIt&#8217;s going to be something that will be looked at,\u201d Abbott said. \u201cThe reality also is this, and that is, what&#8217;s needed in that river basin at that location could be far different than it was needed in some other river basin across the state.\u201d<\/p>\n<div class=\"max-md:faux-bleed mb-4 bg-marshmallow pb-5 dark:bg-ramones md:invisible md:mb-0 md:h-0 md:overflow-hidden md:pb-0\">\n<div class=\"flex w-full flex-nowrap justify-center\">For now, Virdell said his focus and that of officials in Kerr County is on locating more victims and helping residents.
